GENERAL PROVISIONS
By placing an order, the Buyer confirms that he accepts the Terms and Conditions for the delivery of goods announced by the Seller. Relations between the Buyer and the Seller are governed by these Terms and Conditions, which are binding on both parties.
ORDERING GOODS
Orders can be sent via the online catalogue (B2B e-shop) using the shopping cart, or by telephone, fax, e-mail or in writing. The subject of the contract is only the goods specified in the order. The condition for the validity of our electronic order is the completion of all the required data in the order form. The order form is also a proposal for a purchase contract, where the purchase contract itself is subsequently formed by confirming the order. In special cases, the seller reserves the right to confirm the order preferably in person or by telephone and to pay the financial deposit to the buyer. In the event that there is a significant change in the foreign currency exchange rate or a change in the price or the range of goods supplied by the supplier during the time the goods were ordered, our company has the right to modify or withdraw the order in agreement with the buyer. The seller reserves the right to withdraw from an already concluded purchase contract in the event that the price for the ordered goods is incorrectly stated on the website.
ORDER CONFIRMATION
Order confirmation is issued and sent by email immediately after receipt and clarification of the order. If the customer does not provide a contact e-mail in the order, the order or its receipt will be confirmed by agreement between the buyer and the seller.
ORDER CANCELLATION
Cancellation of an order is done individually, preferably by telephone.
SHIPPING AND PACKING
Unless otherwise agreed, the goods are sent by the shipping company PPL. The price of postage and packing is determined by the price list of carriers according to the region of delivery. For orders in the aggregate amount of more than 300 EUR, postage and packing is free of charge ( except for EXPRESS shipments and goods that are in the category of oversized items ). For oversized shipments, the prices of postage / freight are determined individually by prior arrangement or on the basis of an order outside the e-shop.
The customer shall notify the seller at the time of purchase whether he wishes to cover the entire order at once, or whether stock items are to be sent immediately and non-stock items in the next package.
PAYMENT CONDITIONS
For one-off cooperation or orders via electronic catalogue (e-shop), the goods are sent on delivery or by prior agreement after payment of the advance invoice. After agreement with the seller on the basis of longer-term cooperation, payment terms can be agreed on the invoice with a due date of 7 - 30 days according to the agreement.
DELIVERY TIME
Delivery time is from 2-21 days unless otherwise stated. The supplier does not guarantee immediate availability of all items. In the event that items are out of stock, we will contact you. We will dispatch items in stock within two working days at the latest. Delivery time is calculated from the date of order confirmation.
CLAIMS, WARRANTY AND GOODS RETURNS
Any complaints are handled by individual agreement and in accordance with applicable law. The buyer is obliged to inspect the goods upon receipt. The buyer is obliged to report any defects to us immediately. We are not liable for defects caused by transport.
The warranty does not cover defects caused by normal use, improper use of the product or improper storage.
We will inform you immediately of the status of the claim.
Returns are best dealt with individually by appointment.
Consumers (without an ID number) may return unused goods within 14 calendar days without giving a reason. Within this period, the consumer must declare his intention to withdraw from the contract. The consumer should return the goods complete, i.e. including all supplied accessories, with complete documentation, undamaged, clean, preferably including the original packaging, in the condition and value in which the goods were received. The consumer may return the goods tested but not used! The buyer undertakes to pay the costs related to the transport and packaging of the goods, any mishandling of the goods other than as they are due, and any restoration of the goods to their original condition. The value of the credit note may be reduced by this amount.
PROTECTION AND PROCESSING OF PERSONAL DATA
The controller of personal data pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR") is ACCUD Europe Ltd., the operator of the online B2b store www.accud-eu.com with its registered office at Kurčatovova 324, Prague, 10900.
The buyer agrees to the processing of the following personal data: name and surname, address, identification number, tax identification number, e-mail address, telephone number (hereinafter referred to as personal data) for the purpose of exercising the rights and obligations under the purchase contract, for the purpose of maintaining the user account, enforcing the rights under the purchase contract and for marketing purposes.
The lawful basis for processing personal data is:
- performance of the contract between the controller and the purchaser,
- the legitimate interest of the controller in providing direct marketing (for sending commercial communications),
- consent to processing for the purpose of providing direct marketing in the absence of an order for goods.
The controller shall store personal data:
- for the time necessary to exercise the rights and obligations arising from the contractual relationship between the purchaser and the controller and to assert claims arising from these contractual relationships,
- for as long as consent to the processing of personal data for marketing purposes is withdrawn, but no longer than 3 years if the personal data is processed on the basis of consent.
Individual contracts are archived by the seller after their conclusion and are accessible only to the controller. After the expiry of the retention period, the controller shall delete the personal data.
The recipients of the personal data are:
- those involved in the delivery of the goods and the execution of payments under the purchase contract,
- providing services for the operation of the e-shop and other services in connection with the operation of the e-shop.
The controller does not intend to transfer personal data to a third country (to a country outside the EU) or to an international organisation.
The Buyer acknowledges that he/she is obliged to provide his/her personal data correctly and truthfully and that he/she is obliged to inform the Seller without undue delay of any change in his/her personal data. The Buyer confirms that the personal data provided is accurate and that he/she has been informed that this is a voluntary provision of personal data.
The Buyer has the right to:
- access to his personal data
- to rectification of personal data
- to erasure of personal data
- object to processing
- to data portability
- withdraw consent to processing in writing to the address or electronically to euro@accud.com
The purchaser has the right to lodge a complaint with the Data Protection Authority if he/she believes that the right to data protection has been violated.
The controller declares that it has taken all appropriate technical and organisational measures to secure personal data and to secure data storage and storage of personal data in paper form. The controller declares that only persons authorised by it have access to the personal data.
The purchaser agrees to the storage of cookies on his/her computer. If the purchase can be made on the website and the seller's obligations under the purchase contract can be fulfilled without cookies being stored on the buyer's computer, the buyer can withdraw the consent according to the previous sentence at any time by sending an e-mail to euro@accud.com.
